The alignment of the sanitary sewer still does not follow what was shown in the approved Preliminary Plat in terms of serving future lots. The Preliminary Plat proposed to place the sanitary sewer beneath Maguire north of Lot 3, and proceeding to the east under Maguire. There was additional line to be installed beneath Cargo Dr. Please see the approved Preliminary Plat for the approved alignment. Although changes or revisions may be allowed, this will require further discussions with Water Utilities, and the proposal to place the sanitary sewer between Lots 3 and 4 and Lots 2 and 5 was not approved by Water Utilities and would not be desired by Water Utilities.

Manhole AA1 is shown connecting to the existing manhole to the northeast. This existing manhole shall be labeled with the City manhole number 14-041. The line and its associated easement appears to encroach-upon an existing Southwestern Bell easement, which is not acceptable. There shall be no overlap of existing easements in this instance.

For planning and revision purposes, future lots 4, 5, 8, 7, and 6 as identified on the approved Preliminary Plat are intended to be served from sanitary sewer lines installed along future Leinweber Rd., and future Cargo Dr. There were no plans at that time to serve any of those lots via a sidelot sanitary sewer as you are proposing. The City made an allowance to allow the installation of a sideyard sanitary sewer to the west of Lot 1 if proper procedures were followed, but we did not agree to allow for the continuation of this policy for the future lots discussed above. Please review, evaluate, and revise as appropriate. This may require a meeting to to discuss further with City staff, including Water Utilities.

Please review, update, and revise as appropriate.

It would appear there are significant issues with this plan. The connection point appears to be absent the required easement(s), the line and proposed easement encroaches into an existing Southwestern Bell easement which is not allowed, and the geometry and layout continues to show significant issues when compared to what was approved during the Preliminary Plat phase of this project. The language shall be as follows "Sanitary Sewer Easement: A permanent and exclusive easement is hereby granted to the City of Lee’s Summit to patrol, alter, conduct surveys, construct, erect, inspect, install, maintain, operate, rebuild, reconstruct, relocate, remove, renew, repair and replace sewer pipe lines, manholes, and appurtenances thereto, including the right and privilege at any time and from time to time to enter upon, over, under, through, across, in, and upon those areas outlined or designated upon this plat at “Sanitary Sewer Easement” or within any street or thoroughfare dedicated to the public use on this plat. Grantor, its successors and assigns, shall not obstruct or interfere with Grantee’s use and enjoyment of the easement granted hereunder by any means, including, without limitation, obstructing or interfering with the operation, maintenance, or access to such pipe lines, manholes, and appurtenances thereto, by erecting, or causing or allowing to be erected, any building, structure, or other improvements on said easement. Grantor, its successors and assigns, to the fullest extent allowed by law, including, without limitation, section 527.188, RSMo., hereby waives any right to request vacation of the easements herein granted. All easements shall, at all times, be deemed to be and shall be a continuing covenant running with the land and shall be binding upon the successors and assigns of the Grantor."
