The easement document must not only specify the Grantee in terms of current owner, but the land for which it applies. As submitted and recorded, the easement merely grants rights to a person, and that person will no longer own the property in question after the sale. We would recommend the applicant submit a courtesy review copy of the easement to the City for review prior to execution and recordation to avoid these situations. Please be aware the original submittal of the easement was left blank for the Grantee, and we understood the applicant would ensure the Grantee was properly identified in terms of name/address, and land to which the easement applies.

At the current time, a Master Drainage Plan may be the best method for assuring the swale in the rear of the lots is installed according to plan.
