General Comments-Every seasonal retail sales location shall have not less the two (2) portable fire extinguishers with a minimum 2A rating, with at least one (1) of which shall be a pressurized water type. Certification of recognized standards or manufacturer verifying the tent fabric has been treated with a flame resistant material. NO hay, straw, shavings, or similar combustible materials that have not been treated to make them flame retardant shall be permitted within any seasonal retail location. At least one (1) sign at each entrance that reads as follows, in letters at least four inches (4”) high on a contrasting background shall be conspicuously posted at each entrance of seasonal retail sales locations: NO FIREWORKS DISCHARGE WITHIN 100 FEET. At least one (1) sign at each entrance that reads as follows, in letters at least four inches (4”) high on a contrasting background shall be conspicuously posted at each entrance of seasonal retail sales locations: FIREWORKS NO SMOKING At least (1) sign, to be provided, showing Prohibited Fireworks Within the City of Lee's Summit shall be conspicuously posted at the entrance of seasonal retail sales locations. All person(s) selling fireworks or offering fireworks for sale shall permit the State Fire Marshal and the marshals deputies, the Lee’s Summit Fire Department, and the Codes Administration for the City of Lee's Summit to conduct inspections, based on the Code of State Regulations, the International Fire Code, and the International Building Codes on any and all seasonal retail sales locations prior to the seasonal retail sales location opening to the public and during normal business operations. Tents, canopies or membrane structures shall not be located within 20 feet (6096 mm) of lot lines, buildings, other tents, canopies or membrane structures, parked vehicles or internal combustion engines. For the purpose of determining required distances, support ropes and guy wires shall be considered as part of the temporary membrane structure, tent or canopy. No person shall throw, use, explode, detonate, or shoot fireworks within three hundred (300) feet of any permanent storage of ignitable liquids, gasoline pump, gasoline filling station, or any non-permanent structure where fireworks are stored, sold or offered for sale.

The tent shall not obstruct fire department access to the fire protection system (Fire Department Connection and fire hydrant) for the building. The parking spots to the east of the tent shall be blocked off and used for emergency vehicle access only. Verified at inspection.

The site plan does not indicate the tent location. Show the proposed tent location on the site plan. Staff may or may not approve the tent location depending on its placement on the property. There is concern that placement of the tent on the portion of the parking lot closest to the street would negatively impact, and possibly block, traffic circulation. Staff proposes the tent be located on the open field area at the furthest north end of the parking lot.

No signage information has been provided. A 32 sq. ft. banner reciting the identity of the licensee (not-for-profit group) is required to be displayed. Signs at least 12" x 12" reciting the identity of the licensee are also required to be displayed the cash register area(s).
